1. Controller
The controller responsible for processing personal data on this website is KMG Global GmbH, Rathausgasse 17, 12529 Schönefeld, Germany, represented by its managing directors Alain Cappelle and Dipl.-Ing. Mirko Wagner. For any privacy questions please contact us at [email protected].
2. Hosting via GitHub Pages
This website is hosted on GitHub Pages, provided by GitHub Inc., 88 Colin P. Kelly Jr. Street, San Francisco, CA 94107, USA. When you visit the site, GitHub processes technically necessary connection data in server log files, in particular your IP address, the date and time of access, the file requested, the referrer and details of your browser and operating system.
The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest lies in providing the website securely and reliably. Without this connection data the website cannot be displayed. Processing also takes place in the USA. According to GitHub, it is certified under the EU-US Data Privacy Framework, which is covered by an adequacy decision of the European Commission (Art. 45 GDPR). The Standard Contractual Clauses apply in addition. GitHub also stores IP addresses for its own security purposes, for which GitHub's privacy statement applies. We have no access to the log files and no influence on how long they are kept.
Fonts and all other design elements are served from this server. No requests are made to Google Fonts or any other third-party provider.
3. Contact by email
If you email us, we process your details to handle your enquiry. The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is answering business enquiries and assessing possible partnerships. Where you yourself become our contracting party, the legal basis is Art. 6(1)(b) GDPR. Our mailbox is operated by Google Ireland Limited as our processor (Google Workspace). See section 4 on transfers to the USA. We keep your message for no longer than 24 months after our last contact, unless statutory retention obligations under commercial or tax law apply (Section 257 HGB, Section 147 AO).
4. Enquiry form
Our enquiry form runs on Google Forms, provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google processes the data as our processor under a data processing agreement pursuant to Art. 28 GDPR. Your entries are stored in a spreadsheet in our Google Workspace account and forwarded by email to our mailbox for website enquiries, which sits in the same account.
We only process the details you enter in the form:
- Name
- Company
- Role
- Email address
- Country or markets of interest
- Type of partner
- Message
Only when you click Send does your browser transmit your entries directly to Google. Google also receives your IP address and browser details. The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is answering business enquiries and assessing possible partnerships. Where you yourself become our contracting party, the legal basis is Art. 6(1)(b) GDPR. You are not legally or contractually obliged to provide any data. Without the mandatory fields, however, we cannot handle your enquiry.
Processing in the USA is possible. Google LLC is certified under the EU-US Data Privacy Framework, which is covered by an adequacy decision of the European Commission (Art. 45 GDPR). The Standard Contractual Clauses apply in addition. We keep your enquiry for as long as we need it to handle it and for a possible collaboration, and for no longer than 24 months after our last contact.
5. Storing your cookie choice
To avoid asking you again on every visit, we store your decision on Google Analytics in your browser's local storage. It stays there until you change it via the cookie settings or clear your browser data. For the protected partner area we also store an access key in your browser's session storage for the duration of your visit. It is deleted when you close the tab. Both are strictly necessary for the service you have requested (Section 25(2) no. 2 of the German Telecommunications Digital Services Data Protection Act, TDDDG).
6. Google Analytics 4
With your consent we use Google Analytics 4, provided by Google Ireland Limited, to analyse how this website is used. No Google script is loaded and no analytics cookies are set before you consent. Google acts as our processor.
The legal basis for storing and reading information on your device is Section 25(1) TDDDG, and for the subsequent processing of personal data Art. 6(1)(a) GDPR.
We process:
- pages and sections viewed, time on page and scroll depth
- clicks on buttons and markets selected on the world map
- starting and submitting the form, including the country or markets of interest you entered
- referrer, approximate region, device type, browser and operating system
- a pseudonymous identifier stored in a cookie
According to Google, Google Analytics 4 does not store IP addresses of users in the EU. Google uses them briefly on servers in the EU to determine the approximate region and then deletes them. Google Signals, advertising features and data sharing with Google are switched off. Event data is deleted after 14 months, the _ga cookie after 2 years. Data may be transferred to the USA on the basis of the EU-US Data Privacy Framework (Art. 45 GDPR), supplemented by the Standard Contractual Clauses. Consent is voluntary. You can use the website in full without it.
You can withdraw your consent at any time with effect for the future. Just click "Cookie settings" in the footer of any page or use this link: Withdraw or change consent. Withdrawal does not affect the lawfulness of processing carried out before it.
7. No other services
This website uses no tag manager, no advertising networks, no social media plugins, no embedded videos and no other analytics or tracking services. We do not use automated decision-making or profiling within the meaning of Art. 22 GDPR.
8. Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR). You can withdraw any consent you have given at any time (Art. 7(3) GDPR). Simply write to us at [email protected].
Right to object under Art. 21(1) GDPR: Where we process data on the basis of Art. 6(1)(f) GDPR, you may object to this processing at any time on grounds relating to your particular situation. We will then stop processing the data unless we demonstrate compelling legitimate grounds or the processing serves the establishment, exercise or defence of legal claims.
You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the member state of your habitual residence, place of work or the place of the alleged infringement (Art. 77 GDPR). The authority responsible for us is the Brandenburg State Commissioner for Data Protection and Access to Files (Die Landesbeauftragte für den Datenschutz und für das Recht auf Akteneinsicht Brandenburg), Stahnsdorfer Damm 77, 14532 Kleinmachnow, Germany.
